Petitioner apprehends his arrest in connection with Runnisaidpur P. S. Case No.159 of 2020 registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

The informant after having received information that liquor was kept in the house of Anil Jha, who is living in Mumbai, by Bhola Rai, Sunil Rai and Ravi Yadav @ Ravi Kumar (the petitioner), raid was conducted and huge quantity of foreign liquor is said to have been recovered from the firewood room meant to keep firewood.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and nothing has been recovered from the possession of the petitioner. The informant did not disclose that from whom, he got information about the

Patna High Court CR. MISC. No.35895 of 2020(2) dt.05-04-2021 2/2 fact that the petitioner and others kept liquor in the house of Anil Jha. 446.94 litres of liquor was recovered. Similarly situated co-accused Bhola Rai has already been granted anticipatory bail by a Coordinate Bench of this Court vide order dated 09.02.2021 passed in Cr. Misc. No.32717 of 2020. Taking into consideration the fact that similarly situated co-accused has already been granted anticipatory bail, the petitioner, above named, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the Court concerned, shall be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Sitamarhi in connection with Runnisaidpur P. S. Case No.159 of 2020, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
