2. Petitioner seeks regular bail in connection with S.T. No. 220 of 2023, arising out of Falka P.S. Case No. 500 of 2022 dated 08.12.2022 registered for the offences punishable under sections 304B and 120B read with section 34 of the Indian Penal Code.

3. The main submissions advanced by learned counsel for the petitioner are that this is the second attempt of the petitioner to get the relief of regular bail and the petitioner's first prayer for the same relief was rejected by this Court vide order dated 02.08.2023 passed in Cr. Misc. No. 47751 of 2023 and the fresh grounds taken by the petitioner for renewing his

No.38462 of 2025(3) dt.27-06-2025 2/3 bail prayer are his long incarceration period in jail which has been about 2 years and 6 months and secondly, the examination of all the material witnesses of the prosecution and thirdly, the informant, father of the deceased, has not supported the main allegation relating to the commission of dowry death and he has deposed before the trial court that the written application which is said to have been filed by him before the SHO, was only signed by him at the direction of the SHO and he did not know the contents of the application and the petitioner, husband of the deceased, did not make the demand of motorcycle before him and in actual, the deceased had illicit relationship with one Raushan Kumar, which was seen by the brother of Raushan Kumar and thereafter, the deceased was rebuked and consequently, she committed suicide by hanging.

4. Learned APP for the State has opposed the prayer of the petitioner.

Considering the aforesaid submissions and mainly taking into account the petitioner's custody period as well as examination of the material witnesses of the prosecution, this Court is of the view that at this stage the release of the petitioner on bail will not affect the prosecution in any manner, in my opinion, the petitioner now deserves to the relief of bail.

No.38462 of 2025(3) dt.27-06-2025 3/3 Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the court concerned in connection with S.T. No. 220 of 2023 arising out of Falka P.S. Case No. 500 of 2022.
