The petitioner has preferred this application for anticipatory bail apprehending his arrest in connection with Ramgarh P.S. Case No. 16 of 2019, registered for the offence under Sections 147, 148, 149, 452, 332, 333, 435, 436, 337, 338, 323, 324, 225, 307, 153(A.A.), 342, 160, 379, 120(B), 353 of the Indian Penal Code and Section 3⁄4 of the Prevention of Damage to Public Property Act.

As per allegation made in the F.I.R., a mob of more than 2000 persons blocked Mohania-Buxar Road by placing the dead body of Shashikala Kumari. It is further submitted that at the instigation of anti-social persons, the mob created nuisance

Patna High Court CR. MISC. No.35472 of 2019(2) dt.04-06-2019 2/2 in which public property was damaged as also a number of police personnel were injured. Altogether 101 persons were identified and were named in the FIR.

Having heard the parties and taking into consideration the general and omnibus nature of allegation and similarly situated co-accused having been granted bail vide order dated 04.04.2019 in Cri. Misc. No. 21142 of 2019 and order dated 11.04.2019 in Cri. Misc. No. 17979 of 2019 and also considering the fact that petitioner has no criminal antecedent, the above named petitioner is directed to surrender in the court below within a period of six weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 1st Kaimur in connection with Ramgarh P.S. Case No. 16 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
