JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 13-03-2015 The petitioner is the elder brother of the husband of the complainant and facing accusation under Section 498A, 354, 379, 406, 506/34 of the Indian Penal Code in connection with Lalganj P.S. case no. 29 of 2014.
Being the guardian of the family he used to demand dowry from the complainant and/or her father. He was persuaded by her husband not to behave in such manner but he did not desist therefrom. On 07.01.2014 in an intoxicating position he is alleged to have abused her parents and brother and on protest caught hold of her hair and pushed her down and made her semi naked. It is alleged that he made an attempt to outrage her modesty.
Considering the allegation and the facts reflected
Patna High Court Cr.Misc. No.39141 of 2014 (2) dt.13-03-2015 2/2 from the impugned order, this Court is not inclined to privileged the petitioner with anticipatory bail. Prayer is rejected. In the event petitioner surrenders and prays for regular bail, the learned Court below shall consider and dispose of the same on its own merit uninfluenced by the present order.
