JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-07-2022 The present writ petition has been filed seeking the following reliefs :- "(1) That this is an application for issuance of appropriate writ(s), order(s) or direction commanding the concerned Respondents to prevent the encroachers not to create any nuisance or to encroach upon the Govt. land in Mauza-Lehara, under Karagahar P.S. within the district of Rohtas pertaining to Thana No. 154, Khata No. 54, Plot No. 338, 339 as well as for removal of encroachment over the land which is exclusively a Govt. land but in order to derive illegal gain and to grab the Govt. land as well the encroachers are creating hindrance and causing nuisance and have illegally encroached for which the petitioner has already approached the competent authority but grievance of the petitioner has not yet been

Patna High Court CWJC No.1032 of 2021(2) dt.22-07-2022 2/2 redressed and the authority respondents are sitting tight over the matter, as such the act of the respondents is illegal, erroneous and unjust and the same is causing serious prejudice to the petitioner."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Karagahar, Rohtas i.e. the respondent no. 4, for taking appropriate action under the provisions of the Bihar Public Land Encroachment Act, 1956.

Accordingly, the present writ petition stands disposed off with liberty to the petitioner to approach the respondent no. 4 and in case, appropriate petition is filed by the petitioner under Section 6(1) of Bihar Public Land Encroachment Act, 1956, within a period of four weeks from today, the respondent no. 4 shall examine the same and pass necessary orders, in accordance with law after hearing the affected parties, within a period of 12 weeks, thereafter.

The writ petition stands disposed off on the aforesaid terms.
