The petitioner has preferred this application for grant of regular bail in a case registered under section 394 of the Indian Penal Code.

As per the prosecution case, the accused persons who were on a motorcycle dashed their motorcycle with the motorcycle of the informant. On the informant falling down, on the point of pistol the accused persons looted the informant's bag containing Rs. 14.29 lacs (approx).

It is submitted by learned counsel for the petitioner that the FIR was registered against unknown. The name of the petitioner transpired in course of investigation in the confessional statement of co-accused Kanhaiya Yadav who has been enlarged on bail vide order dated 25.11.2019 (Annexure-2).

Patna High Court CR. MISC. No.48605 of 2021(4) dt.11-04-2022 2/2 Inspite of being in custody since 3.10.2020 the petitioner has not been put on T.I Parade and charge sheet has been submitted in the case. No incriminating article has been recovered from the petitioner's possession.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the material that has transpired in course of investigation together with the petitioner having remained in custody for more than 1 year 6 months, the Court directs the petitioner to be enlarged on bail in connection with S.T. no. 65 of 2021 (arising out of Tatarpur (University) P.S. Case no. 78 of 2019) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District and Sessions Judge IX, Bhagalpur.
