The petitioner seeks bail in Dumariyaghat P.S. Case No. 07 of 2021, registered for the offence under Section 394 of the Indian Penal Code and Section 27 of the Arms Act. The prosecution case, in brief, is that while the informant was returning home on his motorcycle, two miscreants intercepted him and snatched Rs. 4,000/- (four thousand) and his mobile phone and when the informant protested, they fired at him resulting injury on his leg. Petitioner is not named in the F.I.R. Name of the petitioner has transpired on the basis of confessional statement of co-accused Manish Kumar. No incriminating article has been recovered from the conscious possession of the petitioner and till date, petitioner has not been put on T.I.P. Petitioner is in

Patna High Court CR. MISC. No.48863 of 2021(2) dt.23-11-2021 2/2 custody since 15.06.2021. Investigation is complete. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Motihari, East Champaran in connection with Dumariyaghat P.S. Case No. 07 of 2021.
