JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 01-04-2015 Heard learned counsel for the petitioner and learned counsel representing the State.

Petitioner apprehends his arrest in connection with Ram Krishna Nagar P.S. Case No. 216 of 2013 registered for the offences punishable under Sections 498A, 379, 323, 324, 325, 341/34 of the Indian Penal Code and Sections 3⁄4 of the Dowry Prohibition Act.

Allegedly, the petitioner being husband of the informant started demanding dowry and due to non-fulfillment started torturing and assaulting her and when her father came then the petitioner and his cousin assaulted him.

Submission is of false implication and that the petitioner is blessed with two children, one is living with the

No.38893 of 2014 (2) dt.01-04-2015 petitioner and another is with the informant and only with a view to disturb the marriage of petitioner's sister this false case has been lodged to which the learned APP opposes. Considering the nature of allegation and the position of the petitioner, this Court is not persuaded to grant the privilege of pre-arrest bail to the petitioner, accordingly, his such prayer stands rejected.
