2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 8(b) and 18 of N.D.P.S. Act.

3 . As per F.I.R. allegation against these petitioners is that they along with other co-accused persons are alleged to be involved in the cultivation of opium plants over the forest land.

4. It is submitted on behalf of the petitioners that petitioners are innocent and have falsely been made accused in this case only the basis of suspicion. It is further submitted that the lands on which opium was cultivated does not belong to these petitioners and there is no description in the entire F.I.R. as to how the informant came to know that the opium in question was being cultivated by these petitioners. There is no material on record to suggest the involvement of these

5 . Learned counsel for the State oppose the bail petition .

6 Considering the nature of injury , clean antecedent of these petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned I/C Sesions Judge- Cum- Spl. Judge, N.D.P.S. Act, Gayajee, in connection with Bhadwar P.S. Case No. 11 of 2026 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 .
