The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 427, 504, 506 of the Indian Penal Code and 27 of the Arms Act.
Prosecution case is that on 13.12.2015 at 9 AM the informant along with her brother-in-law (devar) and sister-in-law (gotani) were going towards their field they saw the accused persons ploughing the crops field of the informant. It is further alleged that when brother-in-law of the informant made protest then petitioner no.2 Bilaiti Singh, petitioner no.1 Ram Pukar Singh,
Patna High Court Cr.Misc. No.19912 of 2016 (2) dt.05-05-2016 2/2 co-accused Bijay Singh and Kishore Singh resorted to fire. It is submitted by learned counsel for the petitioners that for the occurrence of 13.12.2015, the FIR was registered on 17.12.2015. At earlier point of time wife of petitioner no.2 lodged Khagaria (Gangaur) P.S. Case No.541/2015 against the husband of the informant and others. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the delayed lodging of the case and the petitioners having no criminal antecedent, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Khagaria, in connection with Khagaria (Gangour) P.S. Case No.793/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
