JUSTICE ANIL KUMAR SINHA ORAL ORDER 31-08-2021 Heard Mr. Ratan Kumar Kunwar, learned counsel for the petitioner and Mr. Md. Nadim Seraj, learned counsel for the L.N. Mithila University, Darbhanga through video conferencing. The petitioner has filed the present writ application for a direction to the respondent - University for payment of retiral dues i.e. pension, gratuity, earn leave, G.I.C., arrears of salary etc.

Learned counsel for the petitioner submits that petitioner retired from the post of "Librarian" in C.M. Science College, Darbhanga. Learned counsel further submits that this writ application may be disposed of with direction to the respondent no. 3 i.e. Registrar, L.N. Mithila University, Darbhanga to consider the representation of the petitioner and dispose of the same in accordance with law.

Having heard learned counsel for the parties, the petitioner is permitted to file a fresh and detailed representation raising his claim before the respondent no. 3 i.e. Registrar, L.N. Mithila University, Darbhanga within a period of one month from the date of receipt / production of a copy of this order and the Registrar, L.N. Mithila University, Darbhanga is further directed to consider and dispose of the representation filed by the petitioner within a period of three months from the date of receipt of the representation.

Needless to say that if any amount is found payable to the petitioner, the same shall be paid by the respondent -University to the petitioner within a further period of two months from the date of disposal of the representation. With the aforesaid observation and direction, this writ petition is disposed of.
