JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 23-05-2016 The petitioner apprehends his arrest in relation to Ekangarsarai P.S. Case No. 50 of 2016 registered under Sections 147, 148, 149, 333, 332, 307, 353 and 504 of the Indian Penal Code.

The allegation is that police party, in course of investigation came to Ekangarsarai and while they were entering in village to search the accused persons including the petitioner, who was present there, started assaulting the police party, thereby injuring one of them, as well.

Learned counsel for the State submits that the police was doing its duty, in course of investigation and there was no reason for the petitioner and others to obstruct the same much less

Patna High Court Cr.Misc. No.21966 of 2016 (2) dt.23-05-2016 assaulted the police officials.

I am not inclined to entertain this application. It is, accordingly, dismissed.

However, petitioner is directed to surrender before the court below within four weeks and seek regular bail where his prayer may be considered on its own merit without being prejudiced to the order of this Court.
