JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-05-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 504, 323, 353 and 436/34 of the Indian Penal Code. The prosecution case is that on 13.01.2016 the informant being SI cum SHO of Belchhi police station received information that one passenger bus met with accident in which several passengers received injury out of which some of the passengers succumbed to the injuries when the informant reached to the place of accident then the FIR named accused persons including 20-25 unknown pelted stones on the police party and blocked the road.

It is submitted by learned counsel for the petitioners that the mob was protesting against the inaction of the police after the

Patna High Court Cr.Misc. No.24186 of 2016 (2) dt.31-05-2016 2/2 bus met with accident. The accusation is omnibus and general against the mob and none have received injuries. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Barh, Patna in connection with Belchi P.S. Case No. 04 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
