This MJC petition has been filed for restoration of CWJC No. 5708 of 2014, which was dismissed for non prosecution vide order dated 26.07.2017.

The petitioner, who has appeared in person, submitted that vide order dated 17.11.2014 the case was adjourned to 15.12.2014 but the case was not listed on 15.12.2014. The petitioner waited for message about the listing of the case but he did not receive any message and the case was listed on 19.12.2014. Thereafter, the case was directed to be listed on 16.01.2015 but the case was not listed on 16.01.2015 and the same was listed on 26.07.2017 on which date the writ petition was dismissed for non prosecution.

Patna High Court MJC No.3445 of 2017(3) dt.21-03-2018 2/2 Considering the facts aforesaid, MJC No. 3445 of 2017 is allowed and CWJC No. 5708 of 2014 is restored to its original file.
