JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-06-2019 This application has been filed for modification of order dated 07.03.2019 passed in Cr. Misc. No. 953 of 2019, by which, the anticipatory bail of the petitioner was disposed of and he was directed to surrender to surrender in the court below within a period of eight weeks along with a bank draft of Rs. 56,000/-, on which, the court below was directed to release the petitioner on provisional bail for a period of five months and the petitioner was directed to deposit the remaining amount in the aforesaid period of five months in five equal installments. It has been submitted by learned counsel for the petitioner that since the mother of petitioner died, he could not surrender in the court below within the time prescribed by this

Patna High Court CR. MISC. No.34224 of 2019(2) dt.21-06-2019 2/2 court and, therefore, the petitioner prayed for extension of time for surrender in the court below.

Considering the facts and circumstances of the case, order dated 07.03.2019 passed in Cr. Misc. No. 953 of 2019 is modified to the extent that a further period of one week from the date of receipt of a copy of this order is allowed to the petitioner to surrender in the court below along with a bank draft of Rs. 75,500/- duly drawn in favour of opposite party no. 2 and the court below is directed to release the petitioner on provisional bail for a period of three months, during which, period the petitioner shall deposit the remaining amount in three equal installments payable in the first week of each month. Once the total amount is paid, the court below shall confirm the provisional bail of the petitioner otherwise, he is free to pass any order as he deems fit and proper.

Accordingly, the modification application stands allowed.
