The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 366A and 120/34 of the Indian Penal Code.
The basic accusation is of kidnapping the minor daughter of the informant.
It is submitted by learned counsel for the petitioner that in the statement, recorded under section 164 Cr.P.C., the victim girl got her age recorded as 20 years whereas the doctor assessed her age between 15 1⁄2 years to 16 1⁄2 years. In 164 Cr. P.C. statement, the victim has stated that she performed marriage with her own sweet will with petitioner no. 1 Dhiraj Singh and
Patna High Court Cr.Misc. No.14026 of 2015 (2) dt.08-05-2015 2/2 petitioner nos. 2 and 3 are parents of petitioner no.1. Considering the 164 Cr. P.C. statement of the victim, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Mufassil P.S. Case No.341 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
