Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 504, 506, 379, 354, 307 and 34 of the Indian Penal Code. 3.

Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and on account of dispute relating to land, an altercation took place in between the sides of the petitioners and the informant, on which both sides assaulted each other. It is further submitted that from perusal of allegation as alleged in the FIR, it would manifest that Rohit is alleged to have assaulted the father-in-law of the informant by garasa and Gautam is alleged to have assaulted her father-in-law by Sabal causing injury

Patna High Court CR. MISC. No.41525 of 2024(2) dt.22-07-2024 2/2 which was found grievous. It is next submitted that as far as petitioner No. 1 is concerned, he is alleged to have assaulted the husband of the informant by iron rod causing injury on hand and as far as petitioner No. 2 is concerned, allegation against him is general and omnibus in nature and has been implicated very wisely by alleging that the occurrence took place on his order. It is also submitted that Rohit and Gautam are in custody. 4.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Pakriwarnwa P.S. Case No. 53 of 2024, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) SUMIT/- U T
