The petitioner apprehends his arrest in Simri P.S. Case No.181 of 2021 registered under Section 30(a) of the Bihar Prohibition and Excise Act.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case due to enmity. It is further submitted that nothing has been recovered from physical possession of the petitioner.
Learned A.P.P. for the State has opposed the prayer for bail by contending that on seeing the police, the petitioner is alleged to have fled away and on search, 21.600 litres of Indian made foreign liquor has been recovered from the house of the petitioner. The petitioner has criminal antecedents. Therefore, the petitioner does not deserve anticipatory bail.
