JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-03-2015 Heard learned counsel for the petitioner as well as leaned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Jehanabad P.S. Case No. 465 of 2014 registered under Sections-406 & 420 of the Indian Penal Code.
The petitioner is an advocate and accusation against him is that he received Rs. 50,000/- in maintenance case on behalf of the informant but made payment of only Rs. 10,000/- to the informant.
Learned counsel for the petitioner drew my attention towards Annexure-2 to this petition and submits that as a matter of fact, only Rs 10,000/- was paid and the informant received the said
Patna High Court Cr.Misc. No.11406 of 2015 (2) dt.24-03-2015 amount before the court and so far as rest amount was concerned; the same was to be paid to the informant after degree of divorce with mutual consent.
Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named above, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of the order in the court below, be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Jehanabad P.S. Case No. 465 of 2014 to the satisfaction of learned Additional Chief Judicial Magistrate, Jehanabad subject to the conditions as laid down u/S 438(2) of the Cr. P.C.
