The petitioners seek anticipatory bail in connection with Mairwa P.S. Case No. 72 of 2014 registered for the offences punishable under sections 341, 323, 307, 504 and 506 read with 34 of the Indian Penal Code.
It has been contended that there is a case and counter case. In the instant case, all the family members including ladies have been made accused and apart from section 307 of the Indian Penal Code, all other sections are bailable in nature. It has also been contended that there is no specific allegation as against the petitioners.
Regard being had to the facts and circumstances of
Patna High Court Cr.Misc. No.36129 of 2014 (4) dt.01-04-2015 2/2 the case, in the event of arrest or surrender in the court below within four weeks from today, both the petitioners, namely, Rita Kuwar and Puja Kumari are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Mairwa P.S. Case No. 72 of 2014, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J) Pradeep/- U T
