JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 448, 341, 323, 324, 325, 427, 307 and 504 of the Indian Penal Code. It is alleged that the petitioner assaulted the informant with spade.

It is submitted by learned counsel for the petitioner that lacerated injury has been found caused by hard and blunt substance, the accusation has been levelled in the background of land dispute and title suit is also pending between the parties. Moreover, there is no accusation of repeating the blow. Considering the fact that accusation is not being corroborated by the medical opinion, let the above named petitioner be released on anticipatory bail, in the event of arrest or

No.11333 of 2015 (2) dt.19-03-2015 2/2 surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saran at Chapra in connection with Bhagwan Bazar P.S. Case No. 142 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. Since the petitioner has criminal antecedent, learned court below will be at liberty to cancel the bail bonds of the petitioner if he defaults for two consecutive occasions or gets involved in some serious nature of offence.
