The petitioner apprehends his arrest in a case registered for the offence under Section 33 / 63 of the Indian Forest Act.

As per the prosecution case, this petitioner and others were constructing the house within the parameter of forest area. It is submitted on behalf of petitioner that land in question was settled in favour of father of petitioner by settlement in Surar Case No. 65 / 92 - 93 and for which, a parwana no. 30 dated 12.12.1996 was issued by the competent authority and as such, the earlier allegation is false. Petitioner has got clean antecedent.

Learned A.P.P. for the State has opposed the bail petition.

No.48926 of 2021(2) dt.21-06-2022 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad (Bihar) in connection with Forest P.S. Case No. 14 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
