Mr. Pankaj ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 27-11-2025 Heard learned counsel for the petitioners, learned counsel for the informant as well as the learned APP for the State.
2. The petitioners apprehend their arrest in connection with Jakkanpur P.S. Case No. 249 of 2022 registered for the offences punishable under Sections 498(A), 304(B), 201/ 34 of the IPC.
3. As per the prosecution case, the petitioners along with other co-accused persons committed dowry death of the deceased for non-fulfillment of demand of Rs. 5 lakh as dowry.
4. The learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. They are the persons of clean antecedents. Learned counsel has further submitted that the petitioners are father-in-law, mother-in-
Patna High Court CR. MISC. No.37153 of 2025(4) dt.27-11-2025 2/2 law and brother-in-law (devar) of the deceased having no concern with day-to-day affairs of the couple. He has further submitted that the innocence of the petitioners is apparent as petitioner no. 2 (mother-in-law) informed the informant about the death of his daughter due to snake bite. The informant came and the dead body was cremated in his presence. FIR has been lodged with some ulterior motive.
5. Learned counsel appearing on behalf of the informant as well as State opposed the prayer for anticipatory bail of the petitioners.
6. After death of the deceased, native family members of the deceased were informed which shows the innocence of the petitioners.
7. Considering the above-mentioned facts and circumstances, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-X, Patna in connection with Jakkanpur P.S. Case No. 249 of 2022, subject to the conditions as laid down under Section 438(2) Cr.P.C./ 482(2) of the BNSS, 2023. (Nawneet Kumar Pandey, J) priyanka/- U T
