Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 22.12.2018 in connection with Harpur P. S. Case No. 66 of 2018, registered for the offences punishable under Sections 302, 201, 34 of the Indian Penal Code.

Admittedly, none had seen the actual killing of the deceased and at best, it is a case of last seen. Learned counsel appearing for the petitioner submits that having more or less, similar allegation, co-accused Diwakar Yadav and two others have already been granted privilege of

Patna High Court CR. MISC. No.35120 of 2019(8) dt.20-11-2019 2/2 bail, vide order, dated 15.04.2019, passed in Cr. Misc. No. 24112 of 2019.

Accordingly, considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Munger in connection with Harpur P.
