2. The petitioners seek bail in a case registered for the offence punishable under Sections 126, 115(2), 117(2), 109(1), 67, 351(2), 352, 83, 89 and 3(5) of the B.N.S.

3. The FIR discloses a story that the informant had left her husband and her in-laws due to some dispute along with her two children and was staying in a rented house. In the meantime, it is alleged that she developed a relationship with one Suraj Kumar and also got married to him at Deoghar where he met the petitioner no. 2 Juli Devi who was introduced to be the sister of the said Suraj Kumar and mother Manju Devi who is petitioner no. 1. It is further alleged that when Suraj Kumar

Patna High Court CR. MISC. No.36761 of 2025(2) dt.28-05-2025 2/3 was not keeping her alongwith him, she went to his house and both the petitioners Juli Devi and Manju Devi who is mother of Suraj Kumar assaulted her.

Learned counsel for the petitioner submits that it would be apparent from the first information report itself that the thrust of the allegation is against Suraj Kumar and the story offered by the informant herself also does not sound very convincing wherein she has stated that she has walked out of her marriage along with her two children and got married to the said Suraj Kumar. The present petitioners have been made an accused in the case only on account of the fact that they are immediate family members of Suraj Kumar and the offences alleged in the first information report are not made out against them. The petitioners are ladies and are in custody since 13.02.2025. Charge-sheet has already been submitted in the case and they have no criminal antecedent.

5. Learned APP for the State has opposed the application for bail.

6. Considering the facts and circumstances of the case, let the above named petitioners, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction
