JUSTICE SHIVAJI PANDEY ORAL ORDER 15-04-2015 Counsel for the petitioners submits that during the pendency of this application, petitioner no.1 Parshuram Thakur died leaving behind heirs and successors mentioned in Para-5 of the MJC application. It has also been pointed out that due to inadvertence, the land of petitioners appertaining to Khata No. 304, plot no. 1607 area 0.05 acre has not been incorporated in the order dated 2nd September 2014 passed in CWJC No. 15047 of 2011.

In such view of the matter, the order is modified to the extent that the name of petitioner no.1 Parshuram Thakur will be deemed to have been expunged and in his place names of his heirs and successors as mentioned in Para-5 of MJC application will be deemed to have been substituted and the land as aforesaid with respect to petitioner no.2 Prabhat Kumar be treated to have been incorporated.
