Heard learned counsel for the petitioner, the informant and leaned APP for the State.
The petitioner apprehends his arrest in Kotwali (Tatarpur) P.S.Case No. 630 of 2013 registered under section 420 and other sections of the IPC.
In sum and substance, the informant alleged that she is the owner of the building and the lands adjoining thereto but the petitioner and his wife, after hatching up conspiracy, sold a piece of land to the tenant of the informant. She came to know about this when the Revenue Clerk came in side the premises of the informant to enquire about the land.
It is submitted that the petitioner has filed a title suit and the land was mutated in his name. It appears that co-accused Remi Pandey, Abhay Kumar Pandey have already been enlarged on anticipatory bail. The case of the petitioner stands on similar footing. The dispute is of civil nature.
Patna High Court Cr.Misc. No.39147 of 2014 (5) dt.24-03-2015 Considering the facts aforesaid, petitioner, named above, in the event of his arrest/surrender before the court below within four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Tatarpur) P.S.Case No.630 of 2013, subject to condition laid down u/s 438(2) Cr.P.C.
