JUSTICE SUDHIR SINGH ORAL ORDER 24-07-2015 The petitioner is apprehending his arrest in Marhaura P.S. Case No.142 of 2010 for the offence under Sections 420, 467, 468, 471, 414 and 120(B) of the I.P.C. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The prosecution case, in short, is that the informant on receipt of a secret information that one vehicle was standing at the door of the petitioner, reached the house of the petitioner along with others and when asked the papers of the said vehicle from the petitioner he replied that the original papers of the Bolero vehicle was not available and he produced its photo copy which was found forged one and the vehicle was seized.

It has been submitted on behalf of the petitioner that

Patna High Court Cr.Misc. No.28897 of 2015 (2) dt.24-07-2015 2/2 the petitioner is the owner of the vehicle in question. In support of the same sale letter has also been enclosed to the present application. It is further submitted that Annexure-2 is the case which was instituted by the father of the petitioner against the informant and in retaliation the informant has instituted the present case.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender before the court below within six months from today be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Saran at Chapra, Marhaura P.S. Case No.142/10 (Tr.No.1362/15) subject to the conditions as laid down under Section 438(2) of Cr.P.C.
