Petitioner apprehends arrest in connection with Sadar P.S. Case No. 78 of 2020 registered for the offence under section 307 and other allied sections of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner has not committed any offence as alleged in the first information report and he has been falsely implicated in this case due to previous enmity and village politics. As a matter of fact, the informant was driving the vehicle in intoxicated condition and he himself loosed the balanced and fell down and sustained injuries. After investigation, the police has also not submitted charge-sheet under section 307 of the Indian Penal

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioner, above named, is directed to be released on bail on furnishing personal bond to the satisfaction of Chief Judicial Magistrate, Dargbhanga in connection with Sadar P.S. Case No. 78 of 2020 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
