JUSTICE PRABHAT KUMAR JHA ORAL ORDER 09-02-2021 Heard Mr. Krishna Prasad Singh, the learned Senior Counsel for the petitioner and the learned Additional P.P. The petitioner seeks bail in Shankarpur P.S. Case No.96 of 2020, giving rise to Excise Case No.489 of 2020, registered under Section 30(a) of the Bihar Prohibition and Excise Act.

The police intercepted one pick-up van and a Zest car. From pick-up van, 62 cartons each containing 24 bottles liquor was recovered and from the Zest car, 5 cartons containing difference brands of Indian made foreign liquor was recovered. The petitioner is said to be the driver of the pick-up van. Mr. Krishna Prasad Singh, the learned Senior Counsel for the petitioner submits that 545 litres of liquor is said to have

Patna High Court CR. MISC. No.37687 of 2020(2) dt.09-02-2021 2/2 been recovered from the vehicle for which the petitioner is in jail for about seven months. The petitioner has got no criminal antecedent. Nitish Kumar was also apprehended along with the petitioner.

Taking into consideration the facts that for recovery of 545 litres of liquor from the vehicle of the petitioner, the petitioner has remained in jail for about seven months and he has got no criminal antecedent, petitioner, namely, Deepak Kumar is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Madhepura in connection with Shankarpur P.S.
