JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-12-2020 Heard learned counsel for the petitioner as well as learned A.P.P. for the State through video conferencing. This is 2nd attempt for grant of bail on behalf of petitioner in S.Tr.No. 102 of 2019, arising out of Kochas P.S. Case No. 72 of 2018, registered for the offence punishable under Section 302 of the Indian Penal Code and Section 27 of the Arms Act.

Earlier, vide order dated 16-07-2019 passed in Cr.Misc. No. 27813 of 2019, the prayer for bail of petitioner was rejected.

It is submitted on behalf of petitioner that uptillnow, eight prosecution witnesses have already been examined and out of them, only P.Ws.1, 2 and 3 have supported the prosecution case. Petitioner is in custody since 15-09-2018.

No.35523 of 2020(2) dt.22-12-2020 2/2 Considering the fact that trial is going on smoothly, I am not inclined to grant bail to the petitioner and accordingly, same is rejected. However, learned trial court is directed to conclude the trial as early as possible, since petitioner is in custody since 15-09-2018.
