JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 25-05-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Sitamarhi P.S. Case No. 107 of 2016 registered under Sections 341, 323, 324, 307, 379, 504, 448 and 406/34 of the Indian Penal Code.

Regard being had to the nature of allegation made in the FIR that on demand of rent, the petitioners started assaulting the informant causing several injuries to him, I am not inclined to grant them pre-arrest bail.

Accordingly, the application preferred under Section 438

Patna High Court Cr.Misc. No.21313 of 2016 (2) dt.25-05-2016 2/2 of the Code of Criminal Procedure is rejected. In case the petitioners surrender and seek bail, the same shall be considered on its own merits without being prejudiced in any manner by this order.
