The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 379 and 420 of the Indian Penal Code. The informant's ATM Card was exchanged and subsequently Rs. 75,000/- was withdrawn from his ATM account.

During investigation, it was found that one Manoj Singh the elder brother of the petitioner gave ATM card of the informant to the petitioner and amount was withdrawn by him. Co-accused Shashikant Prasad also suggested complicity of the petitioner. It is submitted by learned counsel for the petitioner that only on suspicion, the accusation has been levelled and co-accused Shashikant Prasad has been granted regular bail by this Court vide Cr. Misc. No. 577 of 2014.

No.11151 of 2015 (2) dt.18-03-2015 2 / 2 The aforesaid facts constitute good grounds for consideration of prayer for regular bail of the petitioner if he surrenders within a period of six weeks from the date of receipt/production of copy of the order in connection with Wazirganj P.S. Case No. 264 of 2012, pending in the court of the learned C.J.M. Gaya.

With this observation, the application is disposed off.
