The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 448, 324, 504, 506 of the Indian Penal Code and 3(1)(x) of the SC/ST (Prevention of Atrocities) Act.

It is alleged that petitioner no. 1 Mahadeo Yadav caused injury with Farsa on the head of the informant when the informant's brother came to rescue then he was assaulted by petitioner no. 2 Baidyanath Yadav and petitioner no. 5 Jailal Yadav when the wife of the informant came to rescue

Patna High Court Cr.Misc. No.9828 of 2015 (2) dt.11-03-2015 2 / 2 petitioner no. 3 Sanjay Yadav assaulted her. The accused persons also abused the informant by calling caste name.

It is submitted by learned counsel for the petitioners that in the background of land dispute, accusation has been levelled. The injury has been found to be simple. For occurrence of 17.06.2014 when the F.I.R. was registered on 20.06.2014 and F.I.R. reached to the learned court below on 23.06.2014.

Delay in lodging of the case and its delayed transmission to the learned court below constitute good grounds for consideration of prayer for regular bail of the petitioners if they surrender within a period of six weeks from the date of receipt/production of copy of the order in connection with Turkaulia (Banjariya) P.S. Case No. 331 of 2014, pending in the court of the learned C.J.M. East Champaran at Motihari.

With this observation, the application is disposed off.
