Petitioner apprehends arrest in a case registered for the offences punishable under Sections 420, 406 and other allied sections of the Indian Penal Code.

Prosecution case in short is that the petitioner was a deed writer of the forged and manufactured sale deed in which share of the complainant was sold by the accused persons. Learned counsel for the petitioner submits that the petitioner is merely a deed writer and he has no knowledge regarding the title, share and ownership of the parties in respect of the land in question. He further submits that the petitioner has no criminal antecedent and other co-accused, namely, Jai Prakash Mehta, Pawan Kumar, Manju Devi and Pawan Yadav

Patna High Court CR. MISC. No.35213 of 2019(2) dt.29-05-2019 2/2 have already been allowed anticipatory bail by a bench of this Court vide order dated 23.4.2018, passed in Cr.Mis.No. 63271 of 2019.

Considering the facts of the case, let the petitioner, above named, in the event of his arrest/surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in Sonbarsa Rai (Kashnagar OP) Police Station Case No. 129 of 2017, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation and trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
