2. The petitioner apprehends his arrest in connection with Buniyadganj P.S. Case No.270 of 2025 registered for the offences punishable under Sections 262, 126(2), 115(2), 121(1), 109, 132, 352, 351(2) and 3(5) of the BNS.

3. The allegation against the petitioner and the other accused persons is that they obstructed and assaulted the police officials while they were discharging their official duties, thereby causing damage to the police vehicle and injuries to some of the police personnel.

4. Learned Advocate for the petitioner, taking this Court through the F.I.R., submitted that, except for general and omnibus allegations, there is no specific allegation attributing

It is further contended that although some unfortunate injuries were sustained by certain police officials as well as villagers during the scuffle between the villagers and the police personnel, none of the injuries was found to be grievous in nature. It is also contended that one of the co-accused, namely, Surya Manjhi, who is similarly situated and faces identical allegations, has been granted the privilege of anticipatory bail by a Coordinate Bench of this Court in Criminal Miscellaneous No. 17647 of 2026, a copy whereof has been brought on record. The petitioner also has clean antecedents.

5. On the other hand, learned Advocate for the State vehemently opposed the bail application and submitted that the petitioner had actively participated in the occurrence, assaulted the police personnel, and obstructed them in the discharge of their official duties.

Regarding being had to the submissions made on behalf of the parties and considering the omnibus nature of allegation, coupled with the fact that the case of the petitioner stands on the same footing as that of the co-accused who has already been granted anticipatory bail, as also the clean antecedent of the petitioner, let the above named petitioner, be

No.40424 of 2026(2) dt.01-07-2026 3/3 released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VIII, Gaya Ji in connection with Buniyadganj P.S. Case No.270 of 2025, subject to the condition as laid down under Section 482(2) of the BNSS, with further condition that one of the bailors shall be the own/close family members of the petitioner.
