Petitioners apprehend their arrest in connection with Hathwa P. S. case no. 94/2014 registered under section 302/34 of the IPC.

According to the prosecution case itself, deceased left his home on 31.5.2014 and on the very next day, his dead body was recovered from a well. The post mortem report reveals that cause of death of deceased was asphyxia as a result of drowning The only allegation against petitioner no.1 is that she took the deceased from his home and so far as petitioner no.2 is concerned, it is alleged that when enquiry regarding deceased was made, she disclosed wrong fact.

Considering the aforesaid facts and circumstances as well as

No.10126 of 2015 (2) dt.13-03-2015 submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the above named petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj in Hathwa P. S. case no. 94/2014 subject to condition as laid down under section 438(2) of the Cr.P.C.
