The petitioner is in judicial custody in connection with S.T. No. 230 of 2021 arising out of Samastipur Muffasil P.S. Case No. 297 of 2020 registered under Sections 120B and 302 of the Indian Penal Code and Section 27 of the Arms Act lodged on 24.07.2020 by the informant, Keshav Kumar. As per the prosecution story, the informant alleged that while he was going along with Man Mohan Jha (deceased) and reached near Sonbarsa Chowk, were intercepted by motorcycle borne accused persons and thereafter, the accused persons opened fire which includes the petitioner herein. Thereafter, they escaped but not before resorting to indiscriminate firing.

Patna High Court CR. MISC. No.41096 of 2023(2) dt.21-07-2023 2/2 Man Mohan Jha, subsequently, succumbed to his injuries. Accordingly, the FIR.

Considering the kind of allegation has come in the FIR as also the fact that he has 21 criminal cases under his belt, this Court is not inclined to grant him privilege of bail which is accordingly, rejected.
