JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 30-05-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Sahebganj P.S. Case No. 99 of 2019 for the offence under Sections 272, 273/34 of the Indian Penal Code and Sections 30(a), 36 and 38(ii) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 04.05.2019. He further submits that in the instant case total 47.070 litres of foreign liquor was seized. He also submits that the alleged liquor was not seized from the possession of the petitioner but from a tempo parked besides the road. Considering the fact that the petitioner has got no criminal antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/-
