JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-04-2015 The present application has been filed for modification of the order dated 07.01.2015 passed in Cr. Misc. No. 40352 of 2014, whereby the earlier order dated 06.03.2013 passed in Cr. Misc. No. 33763 of 2012 was modified, whereby the petitioner was granted provisional bail in Complaint Case No. 371 of 2008 wherein processes were directed to be issued after cognizance being taken for the offences punishable under Section 420 of the Indian Penal Code and Section 138 of the Negotiable Instruments Act, on condition that petitioner would deposit Rs.

6,00,000/- before learned Court below which was directed to be invested in some fixed deposit scheme in connection with the present case which was subject to the result of the case. The said order was modified subsequently vide order dated 07.01.2015 passed in Cr. Misc. No.

Patna High Court Cr.Misc. No.8866 of 2015 (3) dt.29-04-2015 2/2 vide order dated 06.03.2013 passed in Cr. Misc. No. 33763 of 2012 was to be extended for a further period of four months on deposit of Rs. 3,00,000/- by the petitioner before learned Court below within a period of four weeks, when the provisional bail of the petitioner was to be confirmed on deposit of rest of amount within a further period of three months. The present modification application has been filed to the effect that both the parties have settled their disputes. An affidavit to that effect has been filed on behalf of O.P. No. 2.

In view of the above facts, the order dated 07.01.2015 passed in Cr. Misc. No. 40352 of 2014 is modified to the extent that the provisional bail granted to the petitioner in connection with Complaint Case No. 371 of 2008 is hereby confirmed.
