====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in registered for the offences punishable under Sections 323/34 and other allied sections of the Indian Penal Code.

As per the prosecution case, this petitioner demanded ransom money of Rs.10 lacs on the point of pistol. Thereafter, informant paid him Rs. 3 lacs in three parts and when he did not pay the rest amount, accused persons set the hut of the informant on fire.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case due to land dispute. He submits that the hut in question does not belong to the informant. Moreover, he has not disclosed the mode of payment as alleged.

Learned counsel for the State opposes the prayer for

Patna High Court CR. MISC. No.38926 of 2022(2) dt.22-11-2022 2/2 bail submitting that there is specific allegation of demand of ransom and then realization of the same against the petitioner. Petitioner has got criminal antecedent.

Considering the specific allegation against the petitioner and his criminal antecedent, his prayer for bail is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
