JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 24-05-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Jamalpur P.S.Case No.144 of 2013 registered under Sections 341, 323, 324, 504, 307, 325, 316, 354 read with 34 of the Indian Penal Code.

It is contended that the there is a case and counter case and the members of the prosecution party were aggressor. Be that as it may, regard being had to the fact that the specific allegation of assault in the FIR is against co-accused Suresh Paswan, the petitioners, namely, Leela Devi, Heera Devi

Patna High Court Cr.Misc. No.21042 of 2016 (2) dt.24-05-2016 2/2 and Ram Kumari Devi, who are all ladies, in the event of arrest or surrender in the court below within six weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Benipur, Darbhanga in connection with Jamalpur P.S.Case No. 144 of 2013 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
