JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-02-2015 At the outset, it is submitted that this application with regard to petitioner no. 1 has already been disposed of. Heard learned counsels for the petitioners and the State. The petitioner no. 2 being mother in law of the informant is apprehending arrest in a case registered for the offences punishable under Sections 498A and 376/34 of the Indian Penal Code and sections 3 and 4 of the Dowry Prohibition Act. It is alleged that petitioner no. 2 assisted her husband in committing rape with the informant. Subsequently, the husband of the informant took the informant to Punjab where she was sold to the landlord. Thereafter, she came back and again the father in law made attempt to commit rape.

It is submitted by learned counsel for the petitioners that

No.29479 of 2014 (6) dt.11-02-2015 2/2 the petitioners have been made accused only because the informant performed love marriage with their son which was being opposed by the petitioners. It is further submitted that the husband of petitioner no. 2 and father in law of the informant have already been acquitted.

Considering the thrust of accusation against the husband and father in law of the informant, let the above named petitioner no. 2 be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhagalpur in connection with Kahalgaon P.S. Case No. 217 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
