The issue raised in the present writ petition is no more res integra. Recently the Apex Court has decided the issue in the case of Mukesh Kumar & Anr. Vs. State of Bihar & Ors. Reported in (2017)5 SCC 387.

In view of the judgment of the Apex Court in Mukesh Kumar (Supra), the writ petition is disposed of with direction to the respondents to examine the case of the petitioner in the light
