The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a), 37(b) and 37(c) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, six named accused persons including the petitioner herein who were selling liquor made an attempt to escape but were caught and 130 litres of liquor was recovered.

It is submitted by learned counsel for the petitioner that the petitioner who is a lady has been falsely implicated in the case under a misunderstanding. She has no criminal antecedent and is in custody since 3.3.2021. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case specially the petitioner not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Special Case no.1538 of 2021 (arising out of Digha P.S. Case no.138 of 2021) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna.
