Dr. Indiwar Kumari, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE KHATIM REZA ORAL ORDER 25-06-2025 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

2. The petitioners apprehend arrest in connection with Karakat PS Case No.162 of 2025 dated 15.03.2025, instituted under Sections 191(2), 190, 352, 329(4), 74, 115(2) and 109 of the Bharatiya Nyaya Sanhita, 2023.

3. The prosecution case, in short, is that on the alleged date of occurrence the petitioners along with other accused persons named in FIR came at the door of the informant and

Upon protest by the informant, all the accused persons started assaulting the informant and his family members and co-accused, Sonu Kumar is alleged to have assaulted the brother-in-law of the informant by means of sword and petitioner no.4 Chhotan Kumar is alleged to have assaulted Amresh Kumar on his head due to which he sustained injury on his head. Petitioner no.2, Pintu Kumar, is said to have fired and petitioner no.7, Bir Bahadur Singh, assaulted the informant on his head. Petitioner nos.3, 5 and 6 are said to have assaulted the informant and his wife.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in this case. It is further submitted that both sides are agnates. There is case and counter case between the parties. Counter case has been lodged by the petitioner no.6, Kajal Kumari under different sections of Bharatiya Nyaya Sanhita, 2023 as also under the Arms Act against the informant and others. It is also submitted that the there is specific allegation against co-accused, Sonu Kumar, that he assaulted the brother-in-law of the informant by means of sword and the petitioner no.4, Chhotan Kumar, is said to have assaulted on the head of Amresh Kumar, who sustained injury. So far other petitioners other than Chhotan Singh are concerned, it is submitted that there is general and omnibus allegation. Lastly, it is submitted that the petitioner nos. 1, 2 and 7 have one criminal case each against them and the petitioner nos.3, 4, 5 and 6 have no criminal antecedents.

5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bikramganj, Rohtas, in Karakat PS Case No.162 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

7. The application stands allowed.
