JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-06-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. At the outset, it is pointed out by learned counsel for the petitioners that petitioner No. 2 namely, Sunaina Devi has already been arrested and accordingly, this petition in respect of petitioner No. 2 namely Sunaina Devi stands dismissed being infructuous.
So far as petitioner Nos. 1 & 3 are concerned; they are Gotani and married Nanad of the deceased, who apprehend their arrest in connection with Fatehpur P.S. Case No. 141 of 2014 registered for the offence under Sections-304(B)/34 of the
Patna High Court Cr.Misc. No.13159 of 2015 (3) dt.26-06-2015 2/2 Indian Penal Code.
It is an admitted position that the informant got information regarding the incident on 07-05-2014 and on the very next date i.e. 08-05-2014, he came and found her daughter in the injured condition. Subsequently, on 30-05-2014, the deceased died in course of her treatment and after that, the informant lodged this case.
Considering the aforesaid facts and circumstances as well as submission of the parties, let petitioner Nos. 1 & 3 namely, Meena Devi and Sushma Devi, in the event of their arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Fatehpur P.S. Case No. 141 of 2014 to the satisfaction of Chief Judicial Magistrate, Gaya subject to conditions as laid down u/S 438(2) of the Cr. P.C.
