The petitioner apprehends his arrest in connection with Sherghati P.S. Case No. 178 of 2004 registered under Sections-302, 201/34 of the Indian Penal Code which was registered against one unknown person after recovery of the dead body.
In course of investigation, it came to light that driver and Khalasi of a trailor were killed by robbers and their dead bodies were thrown at different places. Furthermore, it also came to light in course of investigation that Chandauti P.S. Case No. 203 of 2004 was registered after recovery of dead body of driver of the aforesaid trailor and in the aforesaid case, some persons were arrested. Patna High Court Cr.Misc. No.18199 of 2014 (7) dt.23-12-2014 2/2 statement of accused of the above-said Chandauti P.S. Case No. 203 of 2004.
Taking note of the aforesaid facts and circumstances as well as submission of the parties; I do not feel it proper to extend the privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail stands rejected. (Hemant Kumar Srivastava, J) A.K.V./- U T
