JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 13-05-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with Sasaram (Muffasil) P.S. Case No. 1160 of 2011, registered under Section 302 of Indian Penal Code, pending in the Court of 1st Additional District and Sessions Judge, Rohtas at Sasaram.

The accusation is that the petitioner along with Shiv Shankar Rai reached at the door of the informant and started hot talking with the informant regarding cutting of paddy crops. On which informant made protest saying that he has planted the paddy crop, then this petitioner shot fire, which hit to Nandlal Paswan, brother of the informant, who died on the spot.

Learned counsel appearing on behalf of the petitioner submits that the occurrence took place due to land dispute. The

Learned counsel for the State vehemently opposed the prayer of the petitioner and submitted that there is direct allegation against the petitioner, who shot fire at the brother of the informant, who died on the spot.

Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, prayer of the petitioner, above named, is rejected.
