JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-02-2018 Learned counsel appearing on behalf of the petitioner submits that the State Appellate Tribunal is now functional and in that view of the matter he seeks permission to withdraw this writ petition in order to approach the State Appellate Authority. Permission is granted.
In case, the petitioner files appeal before the State Appellate Authority, the Appellate Authority is required to decide the appeal on its own merits after condoning the delay if any in filing the appeal in view of the fact that the petitioner was pursuing the remedy in the nature of writ petition since 2016. With the aforesaid, the writ petition is dismissed as withdrawn.
